On Wednesday, May 9, the Zoning Board of Review will hear an appeal brought forward by a neighbor against the decision of the City Plan Commission (CPC) to grant Preliminary Plan Approval for a proposed development at 1292 Westminster Street.

The CPC's decision made at its February meeting included the granting of waivers from submission of all required plans for state approvals as well as a reduction in required parking. There are conditions for these approvals such as allowing a lien on the property at 334 Carpenter for parking assurances for 1292 Westminster and several others. Background/Summary
Developer Mike Lemoi is proposing a 5 story building with retail on the ground floor, 35 market rate residences, and 22 parking spaces at 1292 Westminster Street. Last year Lemoi received a "dimensional adjustment" from the 4 story zoning restriction, and received Preliminary Plan Approval with conditions from the CPC in February of 2018 that included a parking variance from the 43 required spaces as well as waivers from submission of multiple required plans including grading, drainage, landscaping, site maintenance, state approvals and others.

While the Zoning Board of Review will not be hearing public testimony on May 9, it makes an impact to have a crowd of stakeholders present at the meeting. Neighbors and stakeholders are encouraged to attend and, if possible, make your opinion known silently by holding signs that reflect your concerns, opposition, etc.

Tim More, who has been representing neighbors' interests concerning 1292 Westminster, has also submitted a Summary Judgement regarding this proposed development. Mr. More is claiming, among other things such as improper notice, that the City does not have the right to make arbitrary decisions that grant waivers to developers. A court date has not yet been scheduled but is expected to happen sometime later this spring.
